A SPIKE in disputes over declined travel insurance claims shows buyers need to be savvy about the insurance they buy.

Insurance & Savings Ombudsman has published 22 case notes for resolved travel insurance disputes in the past financial year, compared with an average of 13.5 for the entire past decade. We’ve distilled the cases to 10 tips for anyone buying travel insurance cover.

1. Do not take refusals at face value.

When a sporting tour of South Africa was cancelled for lack of customers, a man’s insurer refused to cover the “cancellation” fee for flights saying it was as a result of “costs or losses arising from the default, error or omission of any tour operator/tour wholesaler”, which was excluded. The ombudsman ruled that the operator had not breached contractual obligations as the right to cancel was written into its contract.

2. “Fear” needs official sanction for cancelled trips.

When a couple cancelled their flights to Europe for fear of contracting swine flu in the midst of an outbreak least year, the insurer would not pay up because there was an exclusion for cancellation due to policyholders’ “disinclination” to travel. There was no travel warning for those destinations from the Ministry of Foreign Affairs and Trade so the insurer did not have to pay up.

3. Beware of “existing conditions”.

Travelling with a medical condition, or pre-dispostion to, for example, back problems, entails risk. As with health insurance, claims relating to medical conditions a person had before buying travel insurance were not covered as one man found when a bout of “septic arthritis” recurred while he was overseas.
